Re: Rudibaugh Pit, Permit No. M-1995-8"57, Annual Fee and Report, Notice of olation No. M-V200-312,
Civil Penalties, and Cease and Desist Order
Dear Mr. Rudibaugh:
C.R.S. 34-32.5-116(3}(a) and (b), 1989 Supp. and Permit No. M-1995-057 require you to submit to the Division of
Minerals and Geology $281.00 in annual fees and an annual report on or before March 7 of each year. As of the
date of this letter the Division has not received your annual fee and report for March 7, 2003. Therefore, you are in
violation of the above cited statute and the provisions of Permit No. M-1995-057. Pursuant to C.R.S. 34-32.5-124 the
Mined Land Reclamation Board hereby assesses Notice of Violation No. MV-2003-012, Civil Penalties in the
amount of $281.00, and Notice and Order to Cease and Desist from ALL mining related activities associated with
Permit No. M-1995-057. The Mined Land Reclamation Boazd also requires that you pay the annual fee of $281.00
and submit the annual report for March 7, 2004.
NOTE; NO PERMITS FOR NEW MINING OPERATIONS SHALL BE GRANTED TO ANY OPERATOR
WHO IS CURRENTLY FOUND TO BE IN VIOLATION IN THIS STATE (C.R.S. 34-32.5-1 ZO} UNTIL THE
VIOLATION IS ABATED.
Ifyou fail to submit your annual fees ($562.00) and 2003 and 2004 annual reports, and the Civil Penalty ($281.00)
assessed by March 16, 2004, this matter will be heard at a Forrnal Public Hearing before the Mined Land Reclamation
Board for consideration of permit revocation and forfeiture of Certificate of Deposit No. 01554, in the amount of
$1,500.00, and your Cash Bond, in the amount of $405.00, for a total bond amount of $1,905.00, at the
March 30, 2004 (or the following day) Board Meeting:
If you submit all past due annual fees, reports, and the Civil Penalties by March 16, 2004, this matter will be
withdrawn from further Board consideration.
