Banta, <br />Division Director <br />The Division has received your adequacy response. We will accept the three <br />subsidence monitoring points proposed. However, the proposed location of <br />these points needs to be noted on the subsidence monitoring points location <br />map (Map 31). Please modify this map to include those points. <br />The Division has also recently received a letter from the Coiorado State <br />Department of Highways (DOH). This letter claims that the DOH owns rights <br />to the coal under State Highway 13. If this is indeed the case, Cyprus Empire <br />Corporation needs to prove right of entry to this coal prior to Division <br />approval of any mining under the highway. Please forward this proof to my <br />attention at your earliest convenience. I have enclosed copies of all the DOH <br />correspondence that we have received concerning ownership of coal under <br />Highway 13. <br />Thank you for the request to delay the decision date until August 13, 1991. <br />The request is approved. <br />If you have any questions, please contact me. <br />Sincerely, <br />r< <br />Carl B.
