The restored recharge capacity supports the approved postmining land use. There is no indication <br />that surface runoff is different from pre-activity quantities. Moisture that infiltrates the ground <br />will combine with area groundwater, or migrate to Dry Creek, as before. The surficial materials <br />overlie (impermeable) Lewis Shale. <br />Rule 4.05.12(2) Minimizes disturbances to the prevailing hydrologic balance in the permit area <br />and in adjacent areas; and <br />As analyzed below, disturbance to the prevailing hydrologic balance in the permit area and in <br />adjacent azeas has been minimized. Sediment ponds are small with little retention volume. <br />Rule 4.05.12(3) Provides a rate of recharge that approximates the premining recharge rate. <br />Rechazge rates appeaz to approximate premining rechazge rates. <br />Rule 4.05.13(4) Monitoring Report Requirements <br />Rule 4.05.13(4)(a) The data collected, including analytical results, shall be tabulated on a site by <br />site basis and kept on fle at the mine office for inspection by the Division. These data shall be <br />submitted to the Division as required in 4.O.i.13(4)(c). <br />The data, compiled in AHRs, is maintained at the offices of Hydro-Environmental Solutions, <br />Inc.,57 10`h Street, Suite B, in Steamboat Springs, CO. The data is submitted to the Division in <br />the AHRs. <br />Rule 4.05.13(4)(6) Ground water and surface water data collection shall be based upon a water <br />year (October 1 through September 30), unless otherwise approved by the Division. <br />The report is in compliance with this rule. The Permit Application Package (PAP) calls for an <br />annual-year report (page 3, Tab14) in lieu of a water yeaz. Cumulative data is presented through <br />January 1 through December 31. <br />Rule 4.05.13(4)(c) A hydrologic report shall be submitted to the Division annually with the date <br />ofsubmittal determined in consultation with the permittee. The annual hydrologic report shall <br />contain at a minimum.• <br />The report is an annual report. It is due by March 1 of each following calendar year (PAP, Tab <br />14, page 3). Solutions requested (February 15, 2005), and the Division approved, a request for <br />extension. The 2004 report was received at the Division on Apri14, 2005. <br />Rule 4.05.13(4)(c)(i) Water quantity data obtained from each monitoring site during the water <br />year; <br />The report is in compliance with this rule.
