It should be noted that although the permit <br />wu structured to provide the flexibility necessary [o allow discharge from points 001, 002, or 003, only <br />Point 002 hu actually been utilized for mine water discharge. <br />As indicted by the accompanying test results, the WET testing inditxte no chronic tozidty for fathead <br />minnows and the only chronic effects for Ceriodaphnra were reproductive. Consistent with the <br />provisions of Put VLA.3.d.3 of the permit, it is our understanding that no irnmediate anion by Kerr <br />is required under these drevmstances. <br />Smal! quantities of mine water remain in the bottom of both Ponds A (Point 001) and B (Point 002). <br />This remaining watu is below the level of the existing discharge orifices and could not be pumped <br />without re-suspending sediments from the pond bottoms. There are also minor quantitiu of mine <br />water existing u ice layers over the pond areas. Given the favonble WET testing results and the fan <br />that the small quantities of remaining mine water will not discharge until spring runoff and will be <br />significantly diluted by surfact runoff flows, Kerr is interested in pursuing the neceswy permit change <br />to return to the previous general permit for stormwater runoff discharge.
