In adrl.itinn, potenCiaiI~l affected rer.c~•oable resource ]ands arc Iimited to <br />the aquifers of the Darren h!emb-•r of the Nesu Verde and the codZ scams overlying the <br />seam to be c::trac•ted within tha Dear No. 3 mine. 1lowevcr, l:1re limited area of these <br />potentially affected aquifers iJt:ich occur within the permit area, and the fact that <br />potential effects to these aquifers are limited to the down-dip, near-outcrop portions <br />of those aquifers and coal seas::, ::•iI1 extremely limit the possible hydrologic effects <br />of subsidence upon this ayuifc-r and the coal seams. Therefore, the proposed mining <br />within the Scar rJo. 3 mine is con.~.irlez'ed, by the Division, to represent no potential <br />threat to c-ithr-r structures or renewable resource lands. <br />1laJever, mapping of the Somarset quadrangle, performed Ly Rahe Junge of the Colorado <br />Geological Survcu, has detcrmir:cd that the mujo.rity of the surface area above the <br />Dear No. 3 mire permit area is veneered by ancient and modern landslide deposits. <br />In addition, a geotechnical incestiyation performed by Rocky 1•fountain Geotechnical, <br />Ir,c., for Bear Coal Companu has confirmed the existence of ancient and modern landslide <br />deposits adjoining the areas of the proposed portalacccss road anc7 portal facilities <br />fnr the Scar h.'o. 3 nine. The stability of these ancient and modern landslide deposits <br />could be affected by rliffezrntial :nlrfacr_ subsidence, if it were to occur, above the <br />Lear Nu. 3 mine mot}sings. .1lthour~h the Dcar Coal Company Iimjects no surface indications <br />of subsidence wi.11 occur ::'itAin these areas, the Division considers the follaJing <br />stipulation necessary to find compliance with the subsidence requirements of the <br />permanent program regulations.
