' ~ ,4'outAJie/ADQine <br />© 1003 Annunl Rsr/nmalian Rrport <br />F'rGrnap• 73, 2004 <br />PyKr •! <br />EFCI has received DMG approval [o retain an existing utility building and associated entrance <br />road and parking area, the Eormer truck tunnel, the Eormer refuse pile haul road, the light-use road <br />to the former Newlin Czeek topsoil pile, the Magpie Creek permanent diversion, and the Monarch <br />Fan road, as permanent postmining structures to support the approved postmining land use. <br />In order to address surface landowner issues the utility building was relocated from Vento to <br />Corley lands. EFCI also converted the existing North Dewatering Well ro a monitoring well to <br />address ongoing ground water monitoring and impact evaluation requirements. In conjunction <br />with final site reclamation work, all remaining roads were graded during 2002. Ongoing road <br />maintenance during 2003 included road inspections, minor grading, and maintenance of associated <br />ditches and drainage structures. Future road maintenance requirements will be dependent on <br />climatic conditions and use levels and will be based on road inspections. <br />4.0 DRAINAGE AND SEDIMENT CONTROL <br />Sedimentation Ponds 1, 2, and 3 in the Mine Area were removed and reclaimed in conjunction <br />with final site redamation activities. Ponds 4 and 5 remain in the Mine Area to provide ongoing <br />drainage and sediment control through the reclamation liability period. Minor regrading of the <br />Pond 3 azea was completed to address landowner concerns. Soil material was replaced prior to <br />permanent revegetation seeding and additional silt fence was installed on the property boundary to <br />complete final reclamation of this azea and prevent off-site impacts. Site inspection identified <br />some rrunor erosion in the vicinity of the reclaimed mine portals, so contour furrows were <br />established prior to 5na1 revegetation seeding to control drainage and erosion. Sediment <br />accumulations that might interfere with drainage in one of the refuse pile perimeter ditches were <br />also noted during site inspection, so the sediment was removed. <br />Consistent with landowner commitments, EFCI removed broken concrete material from the <br />Magpie Creek Permanent Diversion and replaced it with suitable rock materials. Road inspections <br />identified minor erosion of the inlet to Pond 5 off of mine entrance road, which was repaired and <br />riprap was placed to minimize future erosion potential. Future drainage and sediment control <br />activities will be limited to periodic inspection and repair and cleanout (as required) of drainage <br />structures and repair of any areas where excessive tilling or gullying may become a problem. <br />5.0 WEED CONTROL AND OTHER SITE MANAGEMENT ACTIVITIES <br />Minor occurrences of whitetop and thistle were noted during site inspections in an area north of <br />the reclaimed mine portals. EFCI sprayed these areas with 2-4-D, consistent with the approved <br />weed control plan and County weed control guidelines. EFCI will continue to inspect these areas <br />and will implement any necessary weed control measures consistent with management plans in the <br />approved DMG Permit. <br />6.0 BOND RELEASE STATUS <br />EFCI applied for and obtained Phase I Bond Release for the reclaimed Loadout Area in 1998. A <br />Phase I Bond Release and Bond Reduction application for the reclaimed Mine Area was filed with <br />the DMG in early Ocrober 2002. Two bond release inspections were conducted on November 13 <br />and December 5, 2002. The Phase I Bond Release and Bond Reduction was approved by the <br />DMG on April 25, 2003, reducing the bond Lability by $534,012. <br />Revised 8/18/04 <br />
