Walker <br />subject: Review for Compliance <br />date: Mazch 29, 2005 <br />Rule 4.09.1(11) Inspection <br />Rule 4.09.1(11)(a) The fill shall be inspected for stability by a registered engineer or other <br />qualified professional specialist experienced In construction of earth and rockftll embankments <br />under the direction of a qualifted professional engineer at least quarterly) throughout the <br />construction and during the following critical construction periods2: (1)remaval of all organic <br />material and topsoil, (2)placement of underdrainage systems, (3) Installation of surface drainage <br />systems, (4) placement and compaction offill materials, and (5) revegetation. <br />The permittee is in compliance with this rule. t This is a quarterly report. A registered engineer <br />accomplished both the inspection and certification. 2 No critical construction period was <br />encountered during this period. A requirement to complete a surface drain was noted. <br />Rule 4.09.1(11)(b) The qualifted registered engineer shall provide to the Division a certified <br />report within 2 weeks after each inspection) that the fill has been constructed as specified in the <br />design approved by the Division. 2The report shall include a description of any appearances of <br />instability, structural weakness, and other hazardous conditions observed during the inspection. <br />A copy of the report shall be retained at the mine site. <br />The certification indicates that the fill was inspected on March 10, 2005. The report was to be <br />provided to the Division by March 24, 2004 (within two weeks after the inspection, PAP, Exhibit <br />19, Section I, page Ia-4). The report was submitted on a letter of March 18, 2005 and received at <br />the Division on March 22, 2005. 2 The report included observations on instability, structural <br />weakness and other hazardous conditions.
