Gttrmy <br />Division Director <br />Nalual Resource Trustee <br />The status and requirement for upgradient alluvial well HGDAL4 was reviewed <br />during the current 2005 midterm permit review being conducted by the Division <br />of Minerals and Geology (Division). The Division has concluded that the need for <br />this well is as valid for the current facility, at this time, as it would be ifthe <br />Technical Revision 6 facilities were constructed and the site put into envisioned <br />coal operations. Thus the midterm review findings include this topic as a current <br />requirement. <br />As we discussed by telephone this morning, this is advance notice of the <br />requirement to install alluvial well HGDAL4, and include it in your monitoring <br />program, as permitted. See Tab 7, Appendix 7-2, page?-2.5; Tab 13, pages 5, 6, 7, <br />and 10; of the PAP. <br />Please contact me if you have any questions. <br />Sincerely, <br />Byron G.
