Rule 4.09.1(1 1)(a) The fill shall be inspected for stability by a registered engineer or other
qualified professional specialist experienced in construction of earth and rockfill embankments
under the direction of a qualified professional engineer at least quarterly throughout the
construction and during the following critical construction periods: (!)removal of all organic
material and topsoil, (2)placement of underdrainage systems, (3) installation of surface drainage
systems, (4) placement and compaction of fill materials, and (i) revegetation.
The subject inspection was a quarterly inspection accomplished throughout construction, not one
of the critical construction periods. A registered engineer signed and stamped the report.
Rule 4.09.1(11)(6) The qualified registered engineer shall provide to the Division a certifed
report within 2 weeks after each inspection that the fill has been constructed as specified in the
