As described in your e-mail, the report <br />was transmitted to the Division on March 21, 2006. A search of this afternoon failed to <br />find receipt of the report at the Divsion. As it should arrive shortly, the due date for <br />the receipt of the report is extended to March 29, 2006 [originally due March 1, extended <br />to March 15th by e-mail request and approval letter, orally to March 22, and now to March <br />24, 2006). <br />Thank you also for the status report of the 2005 Annual Hydrologic Report. <br />Yours truly, Byron G. Walker, EPS <br />-----Original Message----- <br />From: Jerry Nettleton [mailto:JNettleton@peabodyenergy.com] <br />Sent: Wednesday, March 22, 2006 2:46 PM <br />To: byron.walker@state.co.us <br />Cc: bwatterson@peabodyenergy.com <br />Subject: Twentymile Coal Company - 2nd Quarter Subsidence Report and <br />Annual Hydrology Report <br />Byron <br />Per our recent phone conversation, submittal o£ the 2nd Quarter 2005 <br />Subsidence F:eport was delayed beyond the projected submittal date of <br />03/15/06 due to delays in receiving corrections to the associated 2005 Fish <br />Creek Riparian Vegetation Study report from our contractor (the Project <br />Manager for Habitat Management) was on a three-week vacation in Spain). <br />The corrected study report was received Monday afternoon, and the completed <br />subsidence report was assembled, checked, and Fedex'd to you late yesterday <br />afternoon, and should have been received today. <br />We are currently updating and transferring hydrologic monitoring <br />information to a new database. Difficulties and delays in translating some <br />of our more recent monitoring information have resulted in delays in <br />completing the Annual Hydrology Report. We have requested and received <br />your approval for extension of the due-date for the AHR to April 7, 2006 <br />(refer to e-mails from Brian Watterson dated 02/21/06 and 03/15/06, and <br />your reply dated 03/22/06). Based on conversations with Brian Watterson, <br />we appear to be on target to meet this revised submittal date. <br />We appeciate your patience and cooperation in this matter.
