In 1995 Exxon plans to begin dismantling the retort structure in <br />the Tosco retort compound. The area in question is located immediately below the mine <br />bench, and is comprised of approximately 3.8 acres within "Area 5" of the 1982 Site <br />Disturbance Inventory, which is on file with your office. While this site was originally disturbed <br />in 1965 to construct the semi-commercial scale demonstration plant, pre-dating the MLR Act, <br />the area is considered to be "affected acreage" for the purposes of the present mining permit. <br />In any case, we do not expect the total affected acreage (1130 acres) to change as a result of <br />this activity. <br />If you have any questions regarding this, please do not hesitate to contact me at <br />(713) 978-5657. <br />Sincerely, <br />James F.
