Box 1773 <br />Durango, Colorado 81302 <br />Re: Walker Pit, File M-87-044 and Willow Bend, File No. M-86-165, Possible <br />Temporary Cessation <br />Dear Mr. Dillon: <br />As of this date this office received and reviewed the Walker Pit and Willow Bend <br />Annual Reports. The reports indicated that these sites have been inactive for at <br />least six months. Please refer to the Funerals Rules and Regulations Sections <br />1.6.2 and 1.6.2(2)(a) which state that if an operation ceases production for a <br />period of 180 days or more, the operator must file a Notice of Temporary Cessation <br />with the Board. This notice must state the date of cessation, the reasons for <br />cessation, a plan for the resumption of mining, a description of those activities <br />the operator will take to ensure compliance with the permit reclamation <br />requirements and a description of site maintenance activities to ensure compliance <br />with the performance standards (kule 6). The Notices of Temporary Cessation may be <br />sent in the same envelope but on separate sheets of stationary and should be <br />separate firom other correspondence sent to the Division. <br />As an alternative to temporary cessation, you may wish to amend your permits to <br />indicate that these operations will be intermittently active throughout the life of <br />the mine. The amendment application must include a description of those activities <br />the operator will undertake to ensure compliance with the permit reclamation <br />requirements, and a description of the site maintenance activities which will <br />ensure compliance with the performance standards (Rule 6). Rule 1.6.2(2)(d) <br />addresses this amendment. <br />Since the annual reports indicated that operations have temporarily ceased, you <br />should submit either a request for temporary cessation or a permit amendment within <br />the next 45 days for each of these permits. If the request indicates that the site <br />is sufficiently stabilized, we will approve the request for cessation within sixty <br />days. If the request indicates that there may be some problems with the site, we <br />will either request more information from you, or schedule the site for an <br />inspection. If you submit an amendment to the permit, we will process it within 30 <br />to 90 days for 110 and 112 operations, respectively. <br />If you have questions, please do not hesitate to call. <br />Sincerely, <br />~' /'r <br />Barbara D.
