Walker <br />subject: Review for Compliance <br />date: July 14, 2005 <br />Rule 4.09.1(1 l) Inspection <br />Rule 4.09.1(11)(a) The fill shall be inspected for stability by a registered engineer or other <br />qualified professional specialist experienced in construction of earth and rockfill embankments <br />under the direction of a qualified professional engineer at least quarterly' throughout the <br />construction and during the following critical construction periods2: (1)removal of all organic <br />material and topsoil, (2)placement of underdrainage systems, (3) installation of surface drainage <br />systems, (4) placement and compaction of fill materials, and (5) revegetation. <br />The permittee is in compliance with this rule. 1 This is a quarterly report. A registered engineer <br />accomplished both the inspection and certification. 2 No critical construction period was <br />encountered during this period. A requirement to complete a surface drain was noted. <br />Rule 4.09.1(11)(b) The qualified registered engineer shall provide to the Division a certified <br />report within 2 weeks after each inspection I that the fall has been constructed as specified in the <br />design approved by the Division. 2The report shall include a description of any appearances of <br />instability, structural weakness, and other hazardous conditions observed during the inspection. <br />A copy of the report shall be retained at the mine site. <br />The certification indicates that the ftll was inspected on May 25, 2005. The report was to be <br />provided to the Division by June 8, 2005 (within two weeks after the inspection, PAP, Exhibit <br />19, Section I, page Ia-4). The report was submitted on a letter of June 3, 2005 and received at the <br />Division on June 3, 2005. 2 The report included observations on instability, structural weakness <br />and other hazardous conditions.
