<br />ANNUAL REPORT <br />INSTRUCTIONS <br /> <br />4ccordino to C.R.S. 34-3?-116(3), and C.R.S. 34- 33.i-1 16(3)(al, on the anniverary date of [he permit each yeas <br />the operator shall submit a report and a map shu++'in~ the extent of current disturbances to affected land, <br />reclamation accomplished [o date and during the preczding year, new disturbances that are anticipated to occur <br />during the upcoming year. and reclamation that will be performed during the upcoming year. Please attach such <br />a report :md map to enclosed annual repot form. (.4n adequately labeled map [hat clzarly delineates and includes <br />the above elements may suffice for a written report.) <br />If your operation is subject to the provisions of Temporary' Cessation as dzfined tit the Act and Rules, you must <br />providz with the Annual Rzpon the following inforntaUan as required by ?CCR 407-1, -107-4, and Rules <br />1.13.7(1){a): <br />(i) the condition of thz operation at the time of cessation: <br />(ii) what specific measures have been and will be implemented to comply with reclamation, pzrfonnance <br />standards and Environmental Protection Plan requirements, if they are pan of your approved application; and <br />iiii) plans for resumption of mining operations. <br />Please provide the additional following information with your Annual Report, as applicable: <br />(a) Per [he requirzmznts of 2 CCR 407-1.407-4, and Rules I.1 ~(] ), providz an updated statement <br />re~ardim~ the cufticiencv of the value of the Financial Warranty, specifically: <br />(i) Pzr the requirements' of 2 CCR 407-t, 407-4, and Rules l.l.i(i)(aj, provide an updated <br />sunement regarding [he sufficiency of the value of the financial warranty. Specifically, <br />irrevocable letters of credit, Deeds of Trust, and security agreements, self-insurance, salvage <br />credit, and first priority liens on project related fixtures. <br />(ii) Per thz requirements of 2 CCR 407•], 407-4, and Rules 1. ] 5(])(b), permits secured with a <br />Deed of Trust or a Security Agreement, the operator shall submit an update, by a qualified <br />independznt appraiser, indicating any changes in propery value, and a statement. summarizing <br />any circumstances which may affect the adequacy of the Deed of Trust, or Security agreement, <br />and the ealue of the proper[}' st:bject to either of these i:,struments. The repot: shall also provide <br />proof that therz are no past-duz property tazzs. <br />(i1 Per the requirements of ?CCR 407-1, 407-4, and Rules 4.7(3), permits secured with an <br />Irrevocablz Letter of Credit, the operator shall have thz bank provide documentation in the form <br />of a balance sheet, certified by a Certified Public Accountant. demonstrating that the Letter of <br />Credit does not exczed ten percent (10`ic) of the bank's capital surplus accounts. <br />(iij Pzr the requirements of 2 CCR 407-I. 407-4, and Rules -t.9.3(c). permit; secured by a First <br />Priority Lien on any tixtitres and Equipment, the operator shall provide a report in sufficient <br />dztail to fully describe the condition, value, and location of all pledgzd fixtures and equipment. <br />(bj Per the requiremznts of 2 CCR 407-1, 407-4, and Rules I. I i(1)(c/. all monitoring information <br />required as part of the approved permit application, to include the Environmzntal Protection Plan. iPlease <br />ogre that if you are not a Designated Mining Operation, you will not have an Environmental Protection <br />Plan as part of your approved permit.) <br />
