<br />Colowyo's Response: <br />Please refer to Colowyo's response to comments relating to the tissues <br />raised during the Division's review and resulting technical adequacy letter of <br />the 2004 Annual Reclamation Report dated 4 August 2006. Again, this issue <br />will be addressed through the permit revision process reiterating the <br />importance of reaching a consensus among the stakeholders prior to the <br />submittal of any revisions. Colowyo feels no further action is needed to <br />address this comment at this time. Plans are already underway to address <br />areas eligible for Phases I and II Bond Release in the near future. <br />10. Based on Exhibit 7 - 2005 Annual Report Map, there aze 20.07 acres that <br />have had the topsoil replaced but have not been seeded. Of the 20.07 acres, <br />11.17 acres have been sitting bare since at least 2003. Reclamation block <br />EP045, 7.2 acres, was reclaimed and had topsoil replaced in 2003. <br />Reclamation block WP012, 3.97 acres, was reclaimed and had topsoil <br />replaced in 2002. The remaining azeas, EP047, 1.9 acres; EP048, 3 acres; and <br />EP049, 4 acres, were all regraded and had topsoil replaced in 2005. All of <br />these areas that have had topsoil replaced in previous reclamation years, <br />EP045, EP046, EP047, EP048, EP049 and WP012, must be reseeded in <br />2006 to ensure compliance with the Rules. Please provide the Division <br />with an explanation why these topsoiled areas were not seeded following <br />topsoil replacement as required. <br />Colowyo's Response: <br />In an effort to complete as much reclamation as possible, EPO47, EPO48 <br />and EPO49 were topsoiled late in 2005 and were unable to be seeded due to <br />weather conditions and snow depths that closed the window of opporn~niry for <br />seeding. EPO45 was to be seeded at the same time as EPO47, EPO48, <br />EPO49 in 2005. WPO12 is a small area at the crest of the current West Pit <br />Fill and is on a 3:1 slope. Site conditions have to be ideal in order for <br />effective seeding of the area to be accomplished safely. These conditions were <br />not present during last year's reclamation activities. EPO45, EPO47, <br />EPO48, EPO49 and WP012 will be seeded in 2006. EP046 was seeded in <br />2005. <br />
