There is an addition error on the Division's Annual Reclamation Report form <br />in Exhibit 3A. Colowyo reports that the cumulative total disturbed acreage is <br />3,840.46 acres. The Division believes that the total should be 3,937.25 acres. <br />The formula for cumulative total disturbed acreage is acres in active mining <br />plus acres in long-term mining or reclamation facilities plus cumulative acres <br />backfilled and graded. Additionally, the cumulative total disturbed acres <br />listed on the ARR form (3,840.46 acres) is more than that permitted for the <br />life of the mine (3,837.00 acres). Please review the acreage numbers <br />reported on the form and make the necessary corrections and resubmit <br />the Annual Reclamation Report form in Exhibit 3A. <br />Colowyo's Response: <br />In 2004, Colowyo reported a cumulative total of 3, 761.96 acres. During <br />2005, Colowyo disturbed 78.50 acres. By adding the cumulative total from <br />2004 (3, 761.96) and adding to it the acres disturbed in 2005 (78.50) a total of <br />3, 840.46 acres was generated and consequently reported to the Division. <br />Colowyo believes this calculation is fairly straightforward The discrepancy <br />identified by the Division reflects the same acre volume that was reclaimed in <br />2005 (96.79 acres). <br />6. Section 8 details the regraded spoil sampling as required in the PAP. In <br />preparing this report the Colowyo Mine used suspect levels that have since <br />been changed (Minor Revision 76, approved by the Division on 27 January <br />200b). The new suspect levels are contained on page 2.05-8 of the PAP and <br />will apply to all future overburden sampling. One of the suspect levels <br />contained on the table on page 2.05-8 needs to be changed. It is noted that <br />sample I-21 shows a SAR level of 6.11. While this is not above the suspect <br />level for the 2005 sampling program, it will be above the suspect level for the <br />2006 sampling, triggering additional sampling and possible remedial actions. <br />Colowyo's Response: <br />Colowyo has an approved Suspect Level Sodium Adsorption Ration of I5. <br />Colowyo has not put forward any changes or mod f cations to suspect levels <br />as related to SAR based on MR-76. Thus, Colowyo feels no action is required <br />in this matter. <br />7. Permit page 2.05-8 states that Colowyo will sample the regraded spoil on 500- <br />foot centers (approximately one sample every five acres). The Division does <br />not have a copy of any map that shows the regraded spoil sampling locations. <br />Please provide the Division with a copy of a map that shows all regraded <br />spoil sampling areas. <br />Colowyo's Response: <br />Colowyo uses a map for internal tracking purposes that can be reviewed <br />during your next site inspection at your request. <br />
