The Division of Minerals and Geology has completed review of the 4th quarter 1999, 1 ~' quarter
2000, 3rd quarter 2000, and 4'" quarter 2000 inspection reports for the Refuse Disposal Area
and Development Waste Pile at the New Elk mine. As a result of this review we have the
following questions or comments.
The Division has two reports titled "Annual Inspection Report" for the RDA pond.
One is dated 2/12/99 and the other is dated 9/16/99. The Division on two prior
occasions asked the following question;
Included with the submittal was an Annual Inspection Report for the Refuse
Disposal Area (RDA) pond. /s this a copy of the report to meet the requirements
of 30 CFR 77.216-3? For which state program rule does this report comply with?
l"he 4th quarter 1999 report for the development waste pile notes that compaction
testing is required and density testing is necessary prior to the placement of any
additional fill. Year 2000 reports continue to indicate that the compaction testing
is required. Also a culvert is mentioned as requiring cleanout in the 2"d quarter.
3'd quarter 2000 inspection notes minor grading and questions whether pile was
ripped and dried as previously noted in the 2"d quarter inspection.
Please provide discussion on plans to conduct testing this year. Also, the
Division does not have a copy of the 2"d quarter 2000 report. Please provide a
copy for Division records.
3. The reports submitted for the RDA include the routine quarterly inspection
reports for the 4'"quarter 1999, 151, 3"', and 4'"quarters 2000. The Division does
not have a 2"d quarter inspection report for the RDA. Please provide a copy of
this report. The reports reviewed satisfy the requirements of Rule 4.09.1(11)(a).
Specific plans for repairs of the slump on the 4th lift outslope are noted in the 4'"
quarter 1999 report. Subsequent reports continue to indicate the need to
complete this repair. Please provide discussion on plans to complete required
repair this year. The Division recommends that color photos be taken during the
repair work and that the repair work is certified as required by Rule 4.09.1(11).
