Box 215001 <br />Denver, Colorado 80221 <br />Re: Hereford Haven Pit - File No. M-78-133, and Hertzog Pit - File No. M-a1~WS; <br />Possible Temporary Cessation <br />Dear Mr. Hickman: <br />We recently reviewed the Hereford Haven Pit and the Hertzog Pit Annual Reports. <br />The reports indicated that these sites have been, and may continue to be, inactive <br />for at least six months. Please refer to the Minerals Rules and Regulations <br />Sections 1.6.2 and 1.6.2 (2)(a) which state that if an operation ceases production <br />for a period of 180 days or more, the operator must file a Notice of Temporary <br />Cessation with the Board. This notice must state the date of cessation, the <br />reasons for cessation, a plan for the resumption of mining, a description of those <br />activities the operator will take to ensure compliance with the permit reclamation <br />requirements and a description of site maintenance activities to ensure compliance <br />with the performance standards (Rule 6). The Notice of Temporary Cessation should <br />be sent to the Division separate from other correspondence. <br />As an alternative to temporary cessation, you may amend your permit to indicate <br />that the operation will be intermittently active throughout its life. The <br />amendment application must include a description of those activities the operator <br />wilt undertake to ensure compliance with the permit reclamation requirements, and a <br />description of the site maintenance activities which will ensure cam~pliance with <br />the performance standards (Rule 6). Rule 1.6.2 (2)(d) addresses this amendment. <br />Since the annual reports indicated that operations have temporarily ceased, you <br />should submit either a request for temporary cessation or a permit amendment within <br />the next 45 days. If the request indicates that the site is sufficiently <br />stabilized, we will approve the request for cessation within sixty days. If the <br />request indicates that there may be sane problems with the site, we will either <br />request more information from you, or schedule the site for an inspection. If you <br />submit an amendment to the permit, we will process it within 30 to 90 days for 110 <br />and 112 operations, respectively. <br />If you have questions, please do not hesitate to call. <br />`S/in~cerely, ~` / <br />5~-~~1C!
