<br />We have received your response to our letter of November 3, 1986 indicating
<br />that your company owes us two years in annual fees (1981 and 1986) totalling
<br />E100,00, Your response was that Albert Frei and Sons was now the operator of
<br />this pit and should be sent this hill, To date, however, no succession of
<br />operators reouest for his permit has been made by you and approved by the
<br />Board, Until this happens you are, under our Rules anA Regulations, the
<br />official operator of this pit and, as such, have the responsibility for
<br />submittal of all annual fees and reports.
<br />The two years of annual fees and an annual report for 198fi (progress of•mining
<br />and reclamation over the last year and plans for next year) should be
<br />suhmitted as soon as possible since they were due by no later than
<br />Novemher 22, 1986, your permit anniversary date. Failure to submit these
<br />items will result in enforcement action against you by our Board in the near
<br />future.
<br />If you wish to avoid the need to submit the annual fee and report next year, I
<br />suggest you arrange with Albert Frei and Sons to transfer Permit No. M-78-279
<br />to ther^ prior to~Noarember 22, 1987, This will involve submittal of a
<br />completed succession of operators form signed by both companies (copy
<br />enclosed) and a new warranty package from the new operator.
<br />Please note that, even if you are not actually on the permit area doing
<br />mining, you are still considered to be the operator of this pit under the
<br />terms of our Rules and Regulations until the permit is formally transferred to
<br />another company, Furthermore, outstanding annual fees would block Board
<br />approval of such a permit transfer,
