Gentlemen:
Pursuant to Senate Bill No. 162 (Revisions to the Mined Land Reclamation Act) ,
signed on May 6, 1988, to become effective July 1 , 1988, the provision which
allowed the exemption of payment of annual t�see based on temporary cessation
status for 110 mining permits was deleted. Subsequent to the passage of the
above legislation the Mined Land Reclamation Board amended the Rules and
Regulations incorporating this change as follows:
34-32-116 Duties of Operators - Annual Report and Fee
All operators having a two acre limited impact permit in accordance with
34-32-110 (1 ) (permits of less than 2 acres, extracts less than seventy
thousand (70,000) tons of mineral , overburden, or a combination thereof per
calendar year, does not extract sand, gravel , or quarry aggregate, is not
located in or adjacent to a stream channel , and does not process minerals by
acid or toxic-forming means) shall submit an annual fee of twenty five dollars
($25 .00) and a map or sketch describing the acreage affected to date and the
acreage reclaimed to date.
All operators having a mining permit in accordance with 34-32-110 (2) (permits
of two acres but less than ten acres , which mining operations will result in
the extraction of less than seventy thousand tons of mineral or overburden per
calendar year) shall submit an annual fee of fifty dollars ($50.00) and a
report and map showing the extent of current disturbances to affected land,
reclamation accomplished to date and during the preceding year, new
disturbances that are anticipated to occur during the upcoming year, and
reclamation that will be performed during the upcoming year. If no new
disturbances or reclamation have occurred during the previous year and no
Changes to the pevious year's map are necessary, then no new map is required,
provided that the operator shall state this in the annual report.
