Since this publication was after the <br />application was filed (irrespective of whether it was "deemed <br />complete" by the Division), this seems to satisfy the Division's <br />Rule 1.6.2(1)(c). Has the Division ever allowed an applicant to <br />publish his notices after the application was filed but before it <br />was "deemed complete" by the Division? If so, what are the names <br />of those applications? <br />With respect to the upcoming hearing on July 23, 1997, regarding <br />the YOUNG GRAVEL SOURCE, the substances leased by Neilsons, Inc. <br />from the Youngs include sand, gravel, and subsoil earth-fill <br />material. The substances leased by Stephen Kinney from the Youngs <br />for the ORION PIT include minerals, mineral substances, and mineral <br />aggregates. According to the Division's interpretation, what is <br />"sand"? What is "gravel"? What is "sub-soil earth fill material"? <br />What are "minerals"? what are "mineral substances"? What are <br />"mineral aggregates"? <br />Given the Division's interpretations of the words in these leases, <br />what is gold-bearing sand? what is gold? What is silica sand? <br />What are rough gemstones? <br />Since neither lease restricts either lessee to a certain depth for <br />the substances to be mined (except that Neilsons, Inc. can only <br />mine subsoil earth-fill, not topsoil earth-fill material), both <br />leases include surface and subsurface materials.
