A review of <br />the permit application indicated the ditch was configured as designed <br />(emphasis added), but that the approved design was inadequate." The report goes <br />on to suggest that Sun Coal review the ditch designs and watershed area, and <br />revise the designs through a technical revision to be submitted by June 23, 1994. <br />Sun Coal does not dispute the Division's ability to require revisions to approved <br />permits, based on observations which indicate the potential or actual non- <br />compliance with permit or performance standard statutes or regulations. <br />In this care, Sun Coal is requesting the Division to provide the measurements <br />and/or specific quantitative evidence that the approved design for this structure <br />was inadequate, and the criteria by which the structure was judged inadequate. <br />Sun Coal requests the ability to review the information by which the Division <br />made this determination prior to submitting a technical revision. Further, Sun <br />Coal desires a meeting with you and any other Division staff involved in the <br />determination of design flaw prior to submittal of the technical revision. <br />Additionally, Sun Coal requests that the submittal date requirement for the <br />technical revision be suspended until such time as the Division has provided Sun <br />Coal with the quantitative evidence of design inadequacy and our meeting. <br />
