Banta. <br />Division Director <br />I have reviewed the submittal referenced above which outlines the latest <br />vegetation sampling program results from the reclaimed Red Canyon Mine. The <br />submittal also requests permission to remove the sediment pond. <br />The findings document for the permit renewal dated July 29, 1988 states on <br />page 20: <br />"The area of surface disturbance at Red Canyon was previously mined land, <br />and as such, the revegetation success criteria of Rule 4.15.10 applies. <br />Vegetative ground cover is the only success criteria which can be applied <br />on previously mined lands. In general, the Division has assumed that the <br />vegetative cover on pre-disturbance native rangeland is "adequate to <br />control erosion" if signs of excessive erosion are not present. In this <br />instance the vegetation success standard is based on total vegetative <br />cove r. in the sagebrush community adjacent to the affected areas at <br />Red Canyon." <br />This document goes on to state: <br />Based on data collected in the summer of 1983, a vegetative success <br />standard of 26% has been established." <br />The submittal received on October 10, 1990 gives a summary of vegetation <br />sampling results. I have checked the calculations for minimum number of <br />samples and agree with the methods and results with one exception. The sample <br />variance should be 50.24, not the 0.005383 that is stated in the submittal. <br />However, this typographical error had no effect on the final results. The <br />average vegetative cover was found to be 52.4 percent; this was fqr above the <br />approved standard of 26 percent. <br />From these vegetation results, and from recent inspections of the mine site, I <br />recommend that we accept the vegetation study results. Further, I believe <br />that a surface water hydrologist should review the submittal to see if it <br />meets all the requirements of Rule 4.05.2(21 governing sediment pond removal. <br />I believe that it does and would recommend removal following spring runoff ang <br />a close check of the site to see that it does not show "... signs of excessive <br />erosion ...". <br />/e rn <br />2166E <br />STATE OF COLORADO <br />
