Box 591 <br />Somerset, CO 81434 <br />RE: Annual Reclamation Report; West Elk Mine; Permit No. C-80-007 <br />Dear Mr. Barbs; <br />In accordance with Rule 2.04.13, the Division has reviewed the 199 3 Annual <br />Reclamation Report for the West Elk Mine. All required issues h ave been <br />addressed adequately. <br />The Division suggests that MCC complete hydroaeeding on the remaining one acre <br />of the relocated topsoil pile as soon as possible. It is recommended that MCC <br />employ various sediment control devices (i.e. silt fences) to protect the topsoil <br />resource until vegetation is established. <br />I will coordinate with the exploration specialist in our office, Barbara Pavlik, <br />regarding inspection of the Raven Gulch exploration road this summer. As a <br />portion of this road is in MCC'e current permit boundary, it was permitted under <br />the mining and reclamation permit, in addition to a Notice of Intent (NOI). Is <br />the only purpose for this road to access drill sites for the Raven Gulch <br />exploration project? Will the road be used to access other facilities (i.e. <br />water monitoring sites) for the West Elk Mine? The purpose and location for this <br />road should be clearly stated and shown in the NOI. If the road ie only intended <br />to be used for exploration purposes, then the Division would release the <br />liability associated with the road under the permit, after it has been determined <br />that the reclamation work under the NOI has been completed and released. <br />Please respond to the above questions by March 18, 1994.
