BANTA, Dlrs¢tor <br />August 21, 1989 <br />Mr. John Horvath <br />Box 176 <br />Hesperus, Colorado 81326 <br />REFERENCE: Annual Fees, Permit M-77-54b, Possible Violation and Civil <br />Penalties <br />Dear Mr. Horvath: <br />On August 4, 1988, we received notice from you that the above referenced <br />mining permit would no longer be your responsibility due to the fact that The <br />First National Bank of Durango was taking over the property. Based on that <br />information I contacted Mr. Richard A. Seul, Executive Vice President of The <br />First National Bank of Durango to determine if a succession of operator would <br />be forthcoming and if the Bank was going to assume the responsibility for the <br />subject permit. Mr. Seul requested the proper forms to accomplish the <br />succession of operator. Forms were mailed to Mr. Seul on August 5, 1988. On <br />August 10, 1988, the Mined Land Reclamation Division received a check from The <br />First National Bank in the amount of $50.00 to cover the annual fees that were <br />due on July 26, 1988. This payment left the permit in good standing. <br />The annual fees in the amount of $50.00 are now due for 1989. To this date we <br />have no record of receipt of a succession of operator request. Neither have <br />we received a Financial Warranty or Performance Warranty from the Bank which <br />would relieve your Letter of Credit #062 in the amount of $2,500. Until such <br />time as a succession of operator request is received and approved, you are <br />still the named permittee on the subject operation and are therefore <br />responsible for all requirements of the permit. <br />I will request the Mined Land Reclamation Board Continue the Formal Public <br />Hearing scheduled for Wednesday, August 23, to allow time to clear this matter <br />up. A determination must be made between you and the Bank as to who is <br />responsible for the annual fees. Those annual fees must be paid prior to the <br />September 27 Board Meeting to avoid a Notice of Violation for failure to pay <br />the annual fees, issuance of a Cease and Desist Order, assessment of Civil <br />Penalties and possible Permit Revocation. <br />215 Centennial Building, 1313 Sherman Street Denver, Colorado 80203-2273 Tel.
