The draft Declaratory Order prepared by Cheryl Linden is attached to this
memorandum. The draft Declaratory Order is largely based on the following
motion that was adopted by the Board on July 26, 1995:
The Division does have the authority to raise these kinds of issues
under the authority delegated to it under Senate Bill 181.
The following resolution was adopted by the Board on July 26, 1995, and
modified by the Board on July 27, 1995. The wording included in the
original resolution, but subsequently stricken, has a i~fle through it.
The modified language of the Board resolution is indicated by graa!.

Resolved that the sense of the Board on the matter that we heard
today concerning Homestake Mining Company, that the direction from
the Division to Homestake to conduct an investigation and
