Somerset is able to handle the <br />current conditions with the existing East Yard Coal <br />Stockpile. <br />East 1'a rd Reclaim and its associated relocation of the <br />East Yard access road will be constructed as resources <br />and scheduling are available. <br />(b) Other Reclamation Activities: <br />As a result of an OSM oversight inspection May 12, <br />1994, the variance to approximate original contour for <br />the Bear Creek portal location was considered to be not <br />in compliance with the approved Colorado program by <br />OSM. Under threat of enforcement action by OSM if <br />reclamation operations were initiated without <br />addressing these concerns, Somerset Mining Company <br />submitted Minor Revision No. 29 to delay the required <br />1994 reclamation at the Bear Creek and Lower Hubbard <br />sites until the issue was resolved between OSM and DMG. <br />Minor Revision No. 29 was modified during review to <br />delay the backfilling and grading requirements, but <br />still required completion of facility demolition. <br />Minor Revision No. 29 was approved on September 23, <br />1994. OSM issued a Ten-Day-Notice to DMG on September <br />29, 1994 for failure to reclaim a mine site to <br />approximate original contour and failure to properly <br />address the requirements for an approximate original <br />contour variance.
