Dear Mr. Fleming:
On September 14, 198.1, the Division of Mined Land Reclamation received an
annual fee payment in the amount of $1,050.OU. To this date, we have no
record of having received the annual report as requested. Submission is
required by the Colorado Mined Land Reclamation Act, Article 32 of Title
34, C.R.S. 1973, as amended and by the Rules and Regulations promulgated
thereunder. Your attention is directed to the following provisions from
Rule 2.4 for operators holding a regular, 112 permit and Rule 3.4 for
operators holding a limited impact, 110 permit.
2.4 Annual Reports
2.41 On the anniversary date of each permit year, the operator shall
submit a report and map (to a scale of not less than 100' to the
inch and not more than 660' to the inch), indicating the phases
of the reclamation plan which have been completed, correlated
with the timetable. The report and map shall contain the
following information:
(1) Location and number of acres affected during that year,
(2) Locations and number of acres reclaimed for that year,
(3) The location and number of acres in various stages of
reclamation (backfilled, graded, topsoil replaced,
re vegetated),
(4) The species of veyetation planted, the locations and the
approximate dates of planting,
(5) The type and approximate quantity of fertilizers, organic
material or soil conditioners used and location of use,
(6) An appraisal of the success of reclamation efforts, and in
the event of failure of any efforts, a short narrative on
the suspected or determined causes of such failure,
(7) Estimates of the location and number of acres to be
affected in the coming year, and
(8) The effective date of the information provided above shall
be no more than 45 days prior to the anniversary date.
