Carol Russell <br /> Reclamation Specialist <br /> Mined Land Reclamation Division <br /> 423 Centennial Building <br /> 1313 Sherman Street <br /> Denver, Colorado 80203 <br /> Re: Nottingham Sand and Gravel/Eagle Pit <br /> Permit Amendment Application <br /> Dear Carol : <br /> This will confirm the resolution which we reached in <br /> our meeting of Thursday, May 10 , 1984 regarding concerns that <br /> you raised with respect to Nottingham Sand and Gravel ' s com- <br /> pliance with the publication of public notice provision in <br /> Rule 2.22( 2) for its pending Eagle Pit permit amendment <br /> application. <br /> Specifically, we understand that the publication <br /> effected by Nottingham Sand and Gravel in the Eagle Valley <br /> Enterprise regarding its permit amendment application commenc- <br /> ing on March 8 , 1984 with the last publication occuring on <br /> March 29 , 1984 is deemed to satisfy the publication require- <br /> ments of Rule 2. 22( 2) . This conclusion is based upon the fact <br /> that Mrs. Courtney Petre, on behalf of Nottingham Sand and <br /> Gravel , requested that the effective date for "filing" of the <br /> permit amendment application be deferred for a period, not to <br /> exceed fifteen ( 15 ) days so as to allow Nottingham sufficient <br /> time to accommodate the delays resulting from mailing time, <br /> the fact that the Eagle Valley Enterprise is only published <br /> weekly and the newspapers requirement that all legal notices <br /> must be received by Friday noon preceding the next Thursday <br /> publication. As we discussed, Mrs. Petrels request is pursu- <br /> ant to the fifteen day extension for the effective filing date <br /> provided in Rule 1 . 1 ( 10 ) . <br /> Thank you for your attention to this matter and <br /> please contact me if you have any further questions . <br /> Very truly yours , <br /> Michael S .
