(Northwest Colorado Consultants, Inc.) has prepared this letter outlining our <br />observations made during the first quarter of 2002 at the Refuse Pile, which is located at the Foidel Creek <br />Mine in Routt County, Colorado. During this quarter, we visited the project site on March 13, 2002 to <br />provide our quarterly observations. <br />At the time of our site visit on March 13, 2002, we me[ with Mc Rick Mills to observe [he conditions at [he <br />Refuse Pile. At the time of our visit, we observed that the majority of the refuse materials (waste coal) that <br />were being produced during this quarter were being stockpiled in Area 1, the western edge of Area 2 and in <br />Area 3. We were advised that they had produced 23,661 cubic yards of waste coal in January and 22,885 <br />cubic yards in February. <br />It should be noted that we did not observe any adverse drainage or geotechnical conditions at [he time of <br />our site visit. Based on our part-time observations, it appears [hat [he waste coal materials that were <br />recently produced, were being stockpiled in general accordance with the project plans and specifications. <br />As suggested in our previous quarterly report, the water levels in the monitor wells installed on October 23, <br />1997 and December 9, 1999 were measured during this quarter on a monthly basis. A graph showing the <br />monthly water levels is attayjhed. <br />This report fulfills th quarterly inspection requirements as specified by Rules 4.09.1(II)(a) and <br />4.10.2(2)(a).
