(Northwest Colorado Consultants, Inc.) has prepared this letter outlining our
observations made during the first quarter of 2002 at the Refuse Pile, which is located at the Foidel Creek
Mine in Routt County, Colorado. During this quarter, we visited the project site on March 13, 2002 to
provide our quarterly observations.
At the time of our site visit on March 13, 2002, we me[ with Mc Rick Mills to observe [he conditions at [he
Refuse Pile. At the time of our visit, we observed that the majority of the refuse materials (waste coal) that
were being produced during this quarter were being stockpiled in Area 1, the western edge of Area 2 and in
Area 3. We were advised that they had produced 23,661 cubic yards of waste coal in January and 22,885
cubic yards in February.
It should be noted that we did not observe any adverse drainage or geotechnical conditions at [he time of
our site visit. Based on our part-time observations, it appears [hat [he waste coal materials that were
recently produced, were being stockpiled in general accordance with the project plans and specifications.
As suggested in our previous quarterly report, the water levels in the monitor wells installed on October 23,
1997 and December 9, 1999 were measured during this quarter on a monthly basis. A graph showing the
monthly water levels is attayjhed.
This report fulfills th quarterly inspection requirements as specified by Rules 4.09.1(II)(a) and
4.10.2(2)(a).
