AFFIDAVIT RE: MINING ACTIVITIES <br />RE: PERMIT NO. - 1995-097 <br />The undersigned, after being first duly sworn and under oath, states and affirms: <br />1. I am a shareholder in New Smuggler Mine Corporation the owner of the <br />Smuggler Mine and the beneficial holder of the above referenced permit. <br />2. Based on actual knowledge, I represent that no activities have taken place <br />that have or would have any affect on the bond requirements for the Smuggler Mine. <br />3. All activities have taken place underground, and have been limited to some <br />minor exploration, remediation, and commercial historic mine tours. <br />4. The bond is a Certificate of Deposit assigned to the Division of Minerals <br />and Geology, is in full force and effect, and continues to be sufficient security for the <br />above referenced permit. <br />Further the affiant sayeth naught. <br />K <br />Gary A.
