Shelton <br />Director <br />June 1, 1981 <br />Mr. Leonard Leukonen <br />Box 333 <br />Lyons, Colorado 80540 <br />RE: Your hard rock operation located 2 miles north of Lyons, Colorado. <br />Dear Mr. Leukonen: <br />It has come to our attention that you are conducting an unpermitted <br />hard rock operation located at Wz Section 6, T3NR70W in Boulder <br />County. <br />A11 mining operators including sand and gravel operators are required <br />to obtain mining and reclamation permits for their mining operations in <br />Colorado per the Colorado Mined Land Reclamation Act, Article 32 of Title <br />34, CRS 1973, as amended. <br />The Mined Land Reclamation Board has directed that your operation be <br />placed on the Mined Land Reclamation Board meeting agenda for consideration <br />of possible violation of the above mentioned statute. This meeting is <br />schedule for June 24-25, 1981, in Denver, Colorado (at) 9:00 A.M., Room 110 <br />State Centennial Building, 1313 Sherman Stteet. <br />At that meeting the Board may issue a Cease and Desist Order for your <br />operation at the above cited location per Article 32 of Title 34, Section <br />123{1) and (2) which states: <br />(1) "Whenever an operator or prospector Fails to obtain a valid <br />permit or file a notice of intent under the provisions of <br />this article, the board may issue an immediate cease and <br />desist order. Concurrently with tl~e issuance of such an order, <br />the board may seek a restraining order or injunction pursuant <br />to Section 34-32-124(3). <br />(2) Any operator who operates without a permit or a prospector who <br />prospects without filing a notice of intent shall be subject to <br />a civil penalty of not less than one hunderd dollars per day nor <br />more than one thousand dollars per day during which such <br />violation occurs; except that any operator eligible for a permit <br />under section 34-32-110 shall be subject to a civil penalty of <br />not less than fifty dollars nor more than two hundred dollars <br />per day during which such violation occurs." <br />
