TO WHOM IT MAY CONCERN:
Tne Mined Land Reclamation Act and Permit No. M-82-129 require you to submit
$50.00 1n annual fees and an annual report b.y August 05 of each year. We have not
received the annual fees and report. Therefore, we have founa that tnere is reason
to believe a vlolatlon exists to Permlt No. M-82-129 and the Law and have
scneduled tnls matter before the Mined Lana Reclamation Board.
A Formal Public Hearing w111 oe held curing the Septelro er 20-'21, 1989 Board meeting
for consioeran on of possible violation, Tne hearing will be Held in Room 22U of
1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter
as the matter can oe consiaered and you will have the oDPOrtunity to be represented
and heard. It wi ll be reiterated that there is reason to believe that you are in
violatlon of trle permit and the Law, specifically the following provision:
Failure to proviae annual fees and annual report required by 34-32-110(4),
C.R.S.
If the Board flnas a violatlon at this nearing, 1t may issue a cease and desist
oraer, assess a civ11 penalty in the amount of $50.00 to $200.00 for each day of
violatlon or order the permit suspended, modiflea, or rev ox ed. In addition, it
mayset the matter for consideration of forfeiture of the $5,000.00 financial
warranty at a suosequent nearing.
