On August 11, 1986 we received a copy of a letter from <br />CMLRB dated July 9, 1986 requesting payment of the annual fees and <br />submission of an annual report and notifying Mr. Glass of a <br />possible violation and hearing. At the outset, I would note that <br />we did not receive notice of the problem until a telephone call by <br />Dave Berry of your staff on August 8, 1986 and our receipt of your <br />letter today. Ple~~se make the necessary changes in your records, <br />as requested in my letter of June 6, 1986 (copy enclosed), to <br />ensure that both the Receiver and myself receive copies of all <br />such notices. <br />A check for $!i0.00 is enclosed in full payment of the annual <br />permit fees. With respect to the annual report, please note that <br />the property has been in receivership since February 28, 1986. <br />From that time to the present the receiver has neither authorized <br />or conducted any s:~nd and gravel excavation activity on the <br />property. We have been informed that all excavation ceased on the <br />property in the Au~tust - September 1986 timeframe due to the <br />financial difficulties of Glass Livestock Co. A permit amendment <br />was submitted to your office in September 1985 to cover additional <br />acreage which the (:NLRB believed had been disturbed in the course <br />of the operation. After a series of delays, the CMLRB approved a <br />"reclamation only" permit on April 24, 1986 and increased the <br />financial warranty to $10,000.00. The additional financial <br />warranty was posteil in the form of a letter of credit by the <br />University National. Bank of Fort Collins in its position as <br />Receiver for the property. The redemption period ends on August <br />18, 1986. We have prepared proposed revisions to the permit which <br />we are currently rf~viewinq with prospective lessees of the site. <br />
