Cattany <br />Division Director <br />Natural Resource Tmstee <br />The Division of Reclamation, Mining and Safety (Division) has initiated a review of the <br />subject report (undated letter, received at the Division on November 16, 2006). The <br />report has been determined incomplete as described herein. Please provide the missing <br />highlighted information. Upon receipt of the missing information, the Division will <br />complete the review. <br />Rule 2.05.6(6)(c)(i)(A) Monuments shall be installed and surveyed prior to the <br />commencement of mining. <br />The subsidence phenomenon at the Foidel Creek Mine has been well documented, and, as <br />has been approved in the Permit Application Package (PAP), monuments are only <br />required under features and structures anticipated to be affected during the reporting <br />period. No long-wall mining occurred during the reporting period under Fish Creek and <br />the railroad tracks. In addition, the anticipated angle of draw has been well documented. <br />Western Area Power Administration and Tri-State/Public Service Company of Colorado <br />power lines were undermined during the reporting period. The top of concrete of each leg <br />of each tower structure was defined as monuments (PAP, page 2.05-191.6). Baseline <br />surveys aze to be accomplished one month prior to undermining and any subsidence <br />(PAP, page 2.05-191.6). <br />Item 1. Please add a line that traces the limit of the affects of the angle of draw at the <br />east end of Panel 19 Right to demonstrate that Fish Creek was not affected by <br />nearby long-wall mining. <br />In addition, please establish monuments at the ponds shown in the SW'/o Sec 4, SWYe Sec <br />5, and N''/4 Sec 9 TSN R86W, in the PAP as appropriate. <br />Item 2. In the information requested under Rule 2.05.6(6)(c)(i)(E) below, please report <br />the date that baseline survey(s) of the monuments were accomplished. The text of the <br />report indicates that survey date had been collected daily starting in May.
