Lnnp <br />Dinsiun Di,eclur <br />RE: Triangle One Pit, Permit No. M-80.228, Annual Fee and Report, Notice of Reason to Believe a Violation <br />Exists <br />Dear Mr. Smith: <br />C.R.S. 34-32.5-116(3)(a) and (b), 1989 Supp. and Permit No. M-80-228 require you to submit to the Division of <br />Minerals and Geology $225.00 in annual fees and an annual report on or before April 27th of each year. As of <br />the date of this letter the Division has not received your annual fee and report for April 27, 1995. Therefore, you <br />are in potential violation of the above cited statute and the provisions of your Permit No. M-80-228. <br />If you fail to submit your annual fee and report to our office by October 18, 1995, this matter will be heard at a <br />Formal Public Hearing before the Mined Land Reclamation Board for consideration of permit revocation, and <br />forfeiture of your Letter of Credit No. 0027 the amount of $2,500.00 at the October 19, 1995 Board Mee[ing. II <br />you submit all past due annual fees and reports by October 18, 1995, we will withdraw this matter. <br />IN ORDER TO AVOID PERMIT REVOCATION, BOND FORFEITURE, AND POTENTIAL CIVIL PENALTIES, <br />PLEASE SUBMIT $225.00 FOR ANNUAL FEES DUE AND YOUR ANNUAL REPORT BY OCTOBER 18, 1995. <br />The Board Meeting will be held on October 19, 1995, in Room 318 of 1313 Sherman Street, Denver, Colorado, <br />beginning at 9:00 a.m. or as soon thereafter as the matter can be considered, and you will have the opportunity <br />to be represented and heard. <br />11 you have any questions, please contact Barbara U.
