July 26, 1995
!"t~ nn~r~.{
Steve Shuey
Colorado Division of Mineral Resources
1474 Main Ave., #207
Durango, CO 81301
,EEIE, ~. ~ iSR5

Re: Ewing Mesa Pit #1
Mine ID M-92-116
Dear Steve:
This is an additional response to your inspection of July 6, 1995. Durango Construction has removed
overburden from the gravel pemtitted area and moved it to the coal permitted area. We do not believe that
this action needed to be resolved W an amendment of the gravel permit because of the following:
1. The removal of the overburden from the gravel permit azea and placement in the coal
permit area was a benefit to both permits.
2. The gmvel permit area has excess of overburden, much more than needed for
reclamation and more than can be reasonably stored in the gravel permitted area. The coal permit will
benefit from [he removal of the ovefiurden and placement in an area already designated for overburden
storage, on the Carbon Junction ovefiurden stock pilelvalley fill.
3. The overburden was not sold by the gravel permit to the coal permit. The transfer was a
gift that was beneficial to both parties.
It is our intention to operate the gravel permit within the regulatory limits and hope that this clarifies the
action we took concerning the overburden. We did not realize and do not believe that we needed to
amend the gravel permit in order Io Vansfer the overburden.
We hope this clarifies the situation
Very y yours,
1;
David L.
