Durango Construction has removed <br />overburden from the gravel pemtitted area and moved it to the coal permitted area. We do not believe that <br />this action needed to be resolved W an amendment of the gravel permit because of the following: <br />1. The removal of the overburden from the gravel permit azea and placement in the coal <br />permit area was a benefit to both permits. <br />2. The gmvel permit area has excess of overburden, much more than needed for <br />reclamation and more than can be reasonably stored in the gravel permitted area. The coal permit will <br />benefit from [he removal of the ovefiurden and placement in an area already designated for overburden <br />storage, on the Carbon Junction ovefiurden stock pilelvalley fill. <br />3. The overburden was not sold by the gravel permit to the coal permit. The transfer was a <br />gift that was beneficial to both parties. <br />It is our intention to operate the gravel permit within the regulatory limits and hope that this clarifies the <br />action we took concerning the overburden.
