The <br />responses pertain to the review document provided by The Colorado Division of Minerals and <br />Geology (CDMG) dated August 3, 2006. The Division comments and the Kerr responses are <br />provided below. <br />1. "Please note That the data for well 79-61 was either left off the diagram (fig. 1) in the <br />current AHR or the overlapping symbols make it unclear if the triangle representing well 79-61 <br />data is present. If the latter is the case, please take care to resubmit that page and clearly show <br />fhe data for well 79-61." <br />Response: Kerr acknowledges that the graphical presentation provided in the AHR is too small <br />making the symbols overlap. The symbols for wells 79-61 and 79-3 were overlapping at that <br />scale. Enclosed is a new figure {Figure 1A) which can be added to the existing document <br />following page 5. Note that historical water levels for well 79-3 have been added to the graph. <br />2. "Please explain the situation with groundwater well 79-3. The diagram shows no historic <br />values, only 2005 values" <br />Response: According to the permit, monitoring in Well 79-3 was not required during the active <br />mining phase except for water levels. TR-19 included a request to revise the Water Monitoring <br />Plan (1991). The revised Monitoring Plan as well as the origina! identified 79-3 as a "bedrock <br />water level well" (BL). Monitoring for water quality was therefore necessary only during the last <br />2 years prior to bond release. Therefore there is no analytical data for this well included in any <br />Annual Hydrology Report dating back to 1989. Exhibit 55 does incude baseline water quality <br />data for the well (Affected Groundwater) dated 1979 and 1980. The water level data has not <br />been included in the previous AHRs. We have revised the 2005 AHR to include the historic <br />water level information. The altered pages to the AHR are enclosed and should replace the <br />same page numbers in the original document. <br />3. "Table 6 is mislabeled. It should read "coal seam water'. <br />Response: Table 6 has been revised accordingly as well as the Table of Contents and page 3 of <br />the AHR.
