The correspondence clearly establishes the fact that Snowmass <br />is not responsible for the discharge. The following excerpts from <br />correspondence illustrate this point: <br />• Letter dated December 4, 1984 from the CDOH to MLRD which states in <br />part, "The division will not require a Colorado Discharge Elimination <br />System (CDES) permit at this time, although it is understood that <br />Snowmass Coal Company will be making application for continued <br />maintenance of the system, should it prove to be viable". <br />• Letter dated December 10, 1984 from MLRD to Snowmass which states <br />in part, "The mine is pre-law and abandoned.
