Eagle Pit, Permit No. 78-352 1984 Annual Report Dear Carol: Enclosed is a check from Nottingham Sand & Gravel Co. for $350. 00 to cover the annual fee for the above pit. The amendment application on this pit which was approved in June by the Mined Land Board contains current information on that pit. No activity is presently occurring at this pit because Chester Goldman and the Denver & Rio Grande Railroad have filed a lawsuit in Eagle County challenging the permit granted by the Board of County Commissioners. The judge issued a stay pending his decision. During the period between the filing of the permit amendment application and the granting of it, one change has occurred which is not reflected on the plats in your possession. The operator graded approximately 2500 linear feet of the south slope of the pit along the railroad and moved the haul road down off the slope and into the bottom of the area being mined. It is the operator' s plan to put approximately six inches of topsoil on this slope and reseed the slope with the approved mixture during the fall. The slopes will also be mulched. The ability to proceed with the topsoiling and seeding, however, will be dependent upon the speed with which the judge rules in the above-mentioned lawsuit; the topsoil to be used is located at the westerly end of the pit area and is therefore a part of the area in which activity is stayed.
