No activity is presently occurring at this pit <br /> because Chester Goldman and the Denver & Rio Grande Railroad <br /> have filed a lawsuit in Eagle County challenging the permit <br /> granted by the Board of County Commissioners. The judge <br /> issued a stay pending his decision. <br /> During the period between the filing of the permit amendment <br /> application and the granting of it, one change has occurred <br /> which is not reflected on the plats in your possession. The <br /> operator graded approximately 2500 linear feet of the south <br /> slope of the pit along the railroad and moved the haul road <br /> down off the slope and into the bottom of the area being <br /> mined. It is the operator' s plan to put approximately six <br /> inches of topsoil on this slope and reseed the slope with <br /> the approved mixture during the fall. The slopes will also <br /> be mulched. The ability to proceed with the topsoiling and <br /> seeding, however, will be dependent upon the speed with <br /> which the judge rules in the above-mentioned lawsuit; the <br /> topsoil to be used is located at the westerly end of the pit <br /> area and is therefore a part of the area in which activity <br /> is stayed. <br />
