BOWIE RESOURCES LIMITED Bowie No. 1 Mine Reclaimed Coal Mine Waste Bank Inspection - 2"d Quarter 2003 On June 22, 2003 I performed a quarterly visual inspection of the Bowie No. 1 Mine reclaimed coal mine waste bank in accordance with Rule 4.10.2. I, J. E. Stover, P.E., have a wide variety of experience in.the design and construction of earth fill embankments. Nothing was observed during the inspection that would indicate the pile has a potential for failure. The pile and surrounding area were dry. Vegetation was flourishing on the pile. No seeps or spoil springs were noted. The pile has been -- reclaimed.- The pile-blends-in-with-the-sarrounding-area so it is difficult to dete~mirie the areal extent of the reclaimed waste pile. Records indicate 15" to 24" of non-toxic material was placed over the coal mine waste. According to the permit, this waste pile was filled to capacity in August 1983 and reclaimed. In the spring of 1985, spontaneous combustion was detected. Topsoil and cover material were excavated and the hot spot was removed. The area was apparently reclaimed again during the Summer of 1988. The design of the waste disposal area is presented in Volume 6A. To the best of my knowledge and belief, based on my inspection of the pile and previous inspections by professional engineers, the coal mine waste bank has been constructed in accordance with the approved plan. According to previous inspections, the pile was constructed with 1.5H:1 V outslopes. The outslopes were stable. The pile is located in a remote area well away from human habitation. A failure of the pile might damage the sediment pond located below the pile.
