Simpson, Assistant State Engineer 0. <br /> SUBJE]CP: Nottingham Sand & Gravel Co. - Amendment to the Eagle Gravel Pit <br /> Permit, File No. 78-352 <br /> As requested, we have reviewed the above referenced amendment application for <br /> a gravel pit. The application states the following: the adjacent Stremme & <br /> Gates ditch will be protected at all times, no sand and gravel will be mined <br /> below the level of the ditch, water to wash gravel will continue to be drawn <br /> by pump from a series of sump wells, and the entire affected area will be <br /> restored to range character after mining. <br /> The water to supply the gravel operation was conditionally adjudicated in <br /> Water Court Case No. W-3940. The application to make the water right absolute <br /> is being protested. The water right if adjudicated would still be junior and, <br /> therefore, subject to administration during periods of call on the Eagle <br /> River. The operator should develop an augmentation plan to allow continued <br /> diversions if a call should occur. The operator should be notified that he <br /> does not have a reliable water supply source if this application is approved. <br /> We do not object to the proposed reclamation plan or the operation of the <br /> gravel pit as long as it is operated in accordance with applicable state water <br /> statutes. <br /> HDS/JRH:ma <br /> cc: Orlyn Bell, Div.
