Cattany
Division Director
Natural Resource Trustee
The Division has reviewed your letter dated August 12, 2005, and both Sandy Brown and I
have had further discussions with you regarding the issues addressed in the letter. Sandy
documented her phone conversation with you earlier today in her email message that was
copied to you (Thursday, August 25, 2005, 12:09 PM). The subject comments originated in
our review letter of July 29, 2005. The comments related to fact that regraded area
sampling to assess physical and chemical characteristics of surface materials had apparently
not been conducted in all required areas at the specified intensity. Further, analyses
associated with a small number of the samples had indicated clay levels that exceeded the
permit specified suspect level.
Responses indicate that all graded areas in the South Extension area will be sampled in
2005 in accordance with the permit specified sample grid. In addition, the letter responses
as clarified by your conservation with Sandy, confirm that SCC did conduct ripping of all
regraded areas. The ripping operations as described conform with the permit specified
remedial action for areas of excess clay content.
As such, Annual Reclamation Report review Items 9 and 10 have been satisfactorily
resolved.
Please contact me if you have any questions.
Since{e y,
Daniell athe s
Environmental P otection Specialist
Denver File
