Groundwater Points of Compliance: <br />Blue Mountain Energy has been installing new wells down-gradient of the anticipated <br />extension of mining to the northeast. These new wells are being placed to serve as <br />groundwater points of compliance for the mine. <br />Further Comments: <br />It is recognized that Blue Mountain Energy was relieved many years ago of the <br />requirement to sample groundwater. However, recent changes in the coal rules will <br />require BME to reinitiate geochemical sampling on some wells. Rule 4.05.13 (1)(b) <br />requires that groundwater points of compliance be established. As discussed above, this <br />has been done at the Desesrado Mine. Responding to 5 CCR 1002-41, Regulation 41, <br />"The Basic Standards for Groundwater," facilities aze required to demonstrate that <br />groundwater quality is maintained for each pazameter at the level of "existing ambient <br />quality as of January 31, 1994" for these points of compliance. The Division therefore <br />requests that BME begin geochemical sampling for the designated groundwater points of <br />compliance for those parameters most sensitive for underground coal operations - <br />pH <br />total dissolved solids <br />Fe (dissolved) <br />Mn (dissolved). <br />The analyses can be done on an annual basis and reported in the annual hydrology report. <br />It is requested that the sampling and reporting begin in the current (2006) water year. <br />If you have any questions, please feel free to call me at 303-866-4928. <br />Sincerely <br />Jim Burnell <br />Environmental Protection Specialist <br />
