Shelton.. ~ <br />RE: Telephone Conversations on June 3rd with Weld County <br />On June 2nd, Brad Janes and Mark Lo ye inspected a Weld County sand and gravel <br />operation located in T3N, R68W, Sec. 35, and T2N, R68W, Sec. 2. The site <br />has no permit, and the county has numerous other pits, which are also unpermitted. <br />I called the county commissioners and spoke to June Steinmark who is a <br />county commissioner. She indicated that the county had allocated funds (51200/ <br />permit) to get applications into the Division for processing. She was surprised <br />that the consultants awarded this contract had not already submitted these <br />applications to the Division. I told her that we were concerned on three <br />general levels. One, the potential immediate flood hazard created by the <br />mining activities on the St. Vrain river at the above location. Secondly, <br />the fact that that operation is unpermitted and needs a permit immediately, <br />and three, the general county problem of not being in compliance with the <br />law. <br />In June of 1978 the Mined Land Reclamation Board issued a cease and desist <br />order to Weld County for all of their operation. In August, two of the <br />applications were considered for permits, but for some reason were continued, <br />perhaps due to 120 problems. The county in turn, sued the state on the <br />grounds that the cease and desist order was illegal. Lew Woods called the <br />county Attorney, Tom David, and discussed the problem with him. Subsequently, <br />the county attorney called me and I had a similar conversation with him as <br />I have had with June Steinmark. The County Attorney said he would be in <br />contact with the county engineer immediately to determine what the situation <br />is, and that they would be calling me back on June 4th at the latest. <br />
