SNOWCAP COAL COMPANY <br />South Portal <br />Roadside Refuse Disposal Area Inspection - 4`h Quarter 2006 <br />On December 18, 2006, I performed the required quarterly visual inspection of the <br />Roadside Refuse Disposal Area in accordance with Rule 4.10.2. <br />I, J. E. Stover, P.E., have a wide variety of experience in the design and construction of <br />earth fill embankments. Nothing was observed during the inspection that would indicate <br />the pile has a potential for failure. The entire pile was damp with snow cover on north <br />facing slopes. There was no seepage noted around the pile. The upper diversion ditch <br />was inspected with no problems noted. <br />A failure of the pile would probably not be a hazard to human life. Even though the pile <br />is fairly close to the Interstate 70 east bound lanes, if the coal mine waste bank failed, it <br />is unlikely the material would move far enough to encroach upon the freeway. <br />I certify that to the best of my knowledge and belief, that the fill and other aspects of the <br />Roadside refuse pile have been constructed as permitted in the design approved by the <br />DRMS. <br />Recommended maintenance: None <br />
