It is the Division's position that neither the oxygen <br />consumption analysis, petrographic analysis, nor the attenuation testing included in the original <br />Shepherd Miller report are, taken in isolation, adequate to demonstrate that seepage from the <br />Bulldog tailing ponds will not result in an adverse impact to ground water resources. However, <br />each of these analyses provide an indication of a low probability of ground water impacts, and <br />taken with the other analyses in the original Shepherd Miller report, constitute a preponderance <br />of technical information that the magnitude of seepage impacts to ground water that may be <br />caused by the Bulldog tailing impoundments will be minimal. Since this is the determination <br />required by the Mined Land Reclamation Act at section 34-32-116(7)(8), the Division, by this <br />letter releases Homestake Mining Company from further responsibility under the ground water <br />protection regulations of the Colorado Mined Land Reclamation Board. <br />If you have any questions, please contact me. <br />Sincerely, <br />/' i~G, v ` ~ /~~"mot/ <br />/~ /~ <br />Allen C.
