r <br />The other feature shown on Map 3 that is important is the feature labeled "Bike Trail Safety <br />Berm" which is located outside the permit area. Although this berm appears to be a soil or <br />overburden stockpile, it is not. This berm is constructed of overburden from this operation. The <br />material used is unsuitable for use in the construction of the compacted berm. <br />This berm was built at the request of the Colorado State Parks. Located a shoe distance to the <br />northwest of this berm is a firing range. Although no problems have occurred in the past, the <br />possibility exists that stray bullets could hit a person on the bike trail. Therefore to protect people on <br />the trail this berm was constructed. Confirmation of this agreement, which was discussed in the land <br />trade negotiations that led to the amendment approved in the last permit year, is available upon <br />request. This feature is described here because it could easily be assumed that Transit Mix of Pueblo is <br />stockpiling overburden outside the permit area.
