Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology has completed review of the 3`d and 4`~ quarter <br />2003 refuse pile inspection reports for the Raton Creek mine, #C-82-055. <br />Review of DMG files indicates we have not received a response to our correspondence of <br />September 17, 2003 concerning prior reviews of refuse pile inspection reports. Please <br />provide a response to that correspondence, including all supporting documents and <br />information concerning seeding and fertilization of materials removed from the sediment <br />pond. <br />Regazding the 3rd and 4`s quarter 2003 reports, each report demonstrates compliance with <br />Rule 4.10.2(2) for coal mine waste banks. In particular, the inspector is noting the <br />presence or absence of seepage that could affect the pile stability, in accordance with <br />Rule 4.10.2(2). Observations aze consistent with field observations noted during Division <br />inspections over the period covered by the reports. <br />We have no further questions or comments at this time. Please submit information as <br />requested within thirty (30) days of receipt of this letter.
