<br />According to C.R.S. 3-4-3_-I 16(3), and C.R.S. ±-1-3?.?-I 16(i)(a), on the anniversary datz of the permit each year,
<br />thz opzra[or shall submit a report and a map showing the e.xtzn[ of current disturbances to affected land,
<br />reclamation accornplishzd to date and during thz preceding year, new disturbances that are anticipated to occur
<br />durine the upcoming year, and reclamation that will be pzrfonned during the upcoming year. Please attach such
<br />a report and map to encloszd annual report form. (.An adequately labeled map that clearly delinzates and includzs
<br />the ab~v~ ~Iz~nts,.may suffice for a written report.)
<br />If your operation is subject [o the provisions of Temporary Cessation as defined in [he Act and Rules, you must
<br />provide with the F\nnual Rzpon the following information as required by 2 CCR -107-1, 107--1. and Rules
<br />1.13.7(I)(a):
<br />(I) the condition of the operation at the time of cessation;
<br />(ii) what specific measures have been and will be implementzd to comply with reclamation,
<br />performance standards and Environmental Protection Plar. requirements, if they are part of your
<br />approved application; and
<br />(iii) plans- for resumption of mining opzrations.
<br />Please provide the additional following information with your Annual Report, as applicable:
<br />(a) Per thz requirements of 3 CCR 407-I, 407-4, and Rules L I ~(I ), provide an updated statement
<br />regarding the sufficiency of the value of the Financial Warranty, specifically:
<br />(L) Per [he requirements of 2 CCR 407-1, 407-4, and Rules 1.1 ~(I)(a), provide an updated
<br />statement resardine the sufficiency of the value of the financial warranty. Specifically,
<br />irrevocable letters of credit, Dezds of Trust, and security agreements, self-insurance, salvaee
<br />credit, and first priority liens on projzct related fixtures.
<br />(ii) Per the requirements of 2 CCR 407-1, 407-4, and Rules l.l~(1)(b), permits secured with a
<br />Geed of Trust or a Security Aereement, the operator shall submit an update, by a qualified
<br />independent appraiser, indica[in~ any changes in property value, and a statement summarizing
<br />any circumstances which may affect the adequacy of the Deed of Tnts[, or Security Aereement,
<br />and the value of the property subject to either of these instruments.
<br />The report shall also provide proof that there are no past-due property taxes.
<br />(iii) Per the requirements of 2 CCR 407-1, 407-4, and Rules =L.7(3), permits secured with an
<br />hrevocable Letter of Credit, the operator shall have the bank providz documentation in the form
<br />of a balancz sheet, certified by a Certified Public Accountant, demonstrating that thz
<br />Letter of Credit does not exceed ten pzrcent (109r) of the bank's capital surplus aczounts.
<br />(vi) Per the requirements of 2 CCR 407-1, 407-4, and Rules 4.93(c), permits secured by a First
<br />Priority Lien on any fixtures and Equipment, thz operator shall provide a report in sufficient
<br />detail to fully describe the condition, valuz, and location of all pledged fixtures
<br />and equipment.
<br />(b) Per the requirements oF3 CCR 407-1, 407-4, and Rules I.l i(1)(c), all monitoring information
<br />required qs part of the approved permit application, to include the Environmental Protection Plan.
<br />(Pleas-e note that if you are no[ a Desi;nated Mining Operation, you will not have an Environmental
<br />Protzction Plan as pan of your approved permit.)
